GENERAL TERMS AND CONDITIONS OF SALE
These General Terms and Conditions of Sale (hereinafter, the “General Conditions”) govern the purchase, by electronic means, of products and services made available on the e-commerce website www.apicolturaregnani.it (hereinafter, the “Site”), managed by:

The sale transactions between Apicoltura Regnani Lendra (hereinafter, the “Seller” or “Supplier”) and the Customer (hereinafter, the “Customer” or “Consumer”) are governed by these General Conditions in compliance with Italian legislation (Italian Legislative Decree no. 70/2003 and Italian Legislative Decree no. 206/2005, the “Consumer Code,” as amended).
The Customer accepts these General Conditions by checking the appropriate box in the order form (checkout) before submitting the order. In the absence of such acceptance, the order cannot be placed.
1. DEFINITIONS
1. Site: the website www.apicolturaregnani.it through which the Seller’s products are offered for sale.
2. Seller/Supplier: Apicoltura Regnani Lendra, as indicated in the header.
3. Customer/Consumer: the natural person who purchases the products offered by the Seller for purposes unrelated to any entrepreneurial, commercial, craft, or professional activity (pursuant to Art. 3 of the Consumer Code).
4. Products: the tangible goods offered for sale on the Site.
5. Order: the purchase request for one or more Products, placed by the Customer via the dedicated procedure on the Site.
2. SUBJECT OF THE CONTRACT
These General Conditions govern the distance selling of food and/or related products produced and/or marketed by Apicoltura Regnani Lendra through the Site. The contract is concluded exclusively via the Internet, when the Customer accesses the Site and submits a Purchase Order according to the procedure provided.
3. REGISTRATION AND ACCEPTANCE OF THE GENERAL CONDITIONS
3.1. Consultation and acceptance
Before placing an Order, the Customer is required to carefully read these General Conditions, which are deemed fully and unreservedly accepted when the Order is confirmed. The General Conditions are always available on the Site and can be viewed at any time.
3.2. Optional registration
Access to the Site is free. To make a purchase, the Customer can either register (create an account) or purchase as a “guest” (guest checkout), if this option is made available. The Customer warrants that the information provided is truthful, correct, and up to date.
4. PRICES AND INVOICING
4.1. Sales prices
All Product prices displayed on the Site are expressed in euros (€) and include VAT, unless otherwise indicated. Any additional taxes or charges (e.g., customs duties) shall be borne by the Customer.
4.2. Price updates
Product prices may be subject to changes, which will be reflected on the Site in real time. The price applied will be the one in force at the time the Order is placed.
4.3. Invoice and tax documents
• For private customers: An invoice is not issued for the purchased products because these are sales transactions not subject to mandatory tax certification pursuant to Article 22, paragraph 1, no. 1 of Italian Presidential Decree 633 of 1972 and Article 2 of Italian Presidential Decree 696 of 1996.
All customers receive an order summary, which holds the same fiscal and legal value as a traditional receipt.
• Customers with a VAT number: who require an invoice must expressly request it at the time of the Order, filling in the appropriate fields and providing all necessary tax details. If an invoice is not requested at this stage, its subsequent issuance cannot be guaranteed.
5. METHODS OF PAYMENT
The Customer may pay for the ordered Products by using one of the following methods, if provided on the Site:
1. Credit card, debit card, or prepaid card (the available circuits are indicated during checkout).
2. PayPal (PayPal’s terms and conditions apply).
6. SHIPPING COSTS AND METHODS
6.1. Courier and delivery times
• The Products will be shipped via an express courier selected by Apicoltura Regnani Lendra, primarily DHL (or other equivalent carriers, if necessary).
• The shipping cost (for both Italy and abroad) is automatically calculated during checkout, based on weight/volume and destination.
• Estimated delivery times for Italy generally range from 2 to 7 working days from the time the Order is received (or from the time payment is credited, in the case of a bank transfer). For international shipments, delivery times vary depending on the destination.
• In the event of any obstacles or delays, Apicoltura Regnani Lendra’s Customer Service will promptly inform the Customer of a new estimated delivery date.
6.2. Delivery address
Delivery will take place at the address provided by the Customer during checkout. It is the Customer’s responsibility to provide a complete and correct address. Deliveries to PO boxes, “poste restante” services, or public places are not available.
6.3. Failed delivery
If the recipient is absent, the courier will attempt a new delivery. If the second attempt also fails, the package will be held at the local branch, where the Customer may collect it within the timeframe set by the courier. Any storage or re-delivery costs may be charged to the Customer, if required by the carrier.
7. RETURNS AND RIGHT OF WITHDRAWAL
7.1. Right of withdrawal for Consumers
Pursuant to Articles 52 et seq. of Italian Legislative Decree no. 206/2005 (Consumer Code), a Customer qualifying as a Consumer has the right to withdraw from the contract, without penalty and without giving any reason, within 14 days from receipt of the Products.
7.2. Exclusions
The right of withdrawal does not apply (pursuant to Art. 59 of the Consumer Code) to goods that are liable to deteriorate or expire rapidly, or to sealed products that have been opened after delivery, where such products are no longer suitable for return for health protection or hygiene reasons.
7.3. Procedure for exercising the withdrawal
To exercise the right of withdrawal, the Customer must send a clear written communication to [email protected] within 14 days from the date of receipt of the product and must also ship the product within the same timeframe.
The withdrawal notice must include:
• Order number and Order date.
• Customer details (name, surname, address, email/phone).
• An explicit statement of the intention to withdraw from the purchase.
• The code or description of the product(s) subject to the withdrawal.
7.4. Product return
The products must be returned intact, in their original packaging and, being food products, they must not have been opened or tampered with. The return shipping address will be provided via email.
7.5. Return shipping costs
Return shipping costs shall be borne by the Customer. The goods travel under the Customer’s responsibility until Apicoltura Regnani Lendra’s warehouse confirms receipt.
7.6. Refund
• Within 10 days of receiving the product in the warehouse, Apicoltura Regnani Lendra will refund the amount paid by the Customer at the time of purchase. Initial shipping costs will not be refunded.
• The refund will be made using the same payment method chosen by the Customer, unless otherwise agreed.
• If returned products are damaged, not intact, or show signs of use beyond normal care, the Customer shall be liable for the reduction in the value of the goods pursuant to Art. 57 of the Consumer Code.
8. CUSTOMER’S OBLIGATIONS UPON DELIVERY
At the time of delivery, the Customer or their representative must verify:
1. That the number of packages delivered matches the number indicated on the transport document.
2. That the packaging is intact and undamaged.
In the event of irregularities (damaged package, tampered packaging, wet box, etc.), the Customer must immediately report them to the courier, accepting the package with written reservation (specifying the reason) on the delivery document. The Customer must also promptly inform the Seller within 10 days of delivery, providing photographic evidence if requested.
9. LIMITATION OF LIABILITY
9.1. Force majeure
Apicoltura Regnani Lendra shall not be held liable for delays or non-delivery caused by force majeure (e.g., natural disasters, extraordinary events, strikes, pandemics, government actions).
9.2. Third-party services
The Seller is not liable for disruptions, delays, or missed deliveries attributable to issues with the courier or other third-party service providers.
9.3. Improper use
Under no circumstances shall Apicoltura Regnani Lendra be held liable for damages resulting from improper use of the products by the Customer or from the Customer’s failure to follow any instructions provided on the product label or on the Site.
9.4. Product information
All product descriptions and images on the Site are intended for illustrative and commercial purposes only. While prepared with due care, they may contain slight discrepancies (e.g., updated labeling from the manufacturer).
10. MODIFICATIONS TO THE GENERAL CONDITIONS
Apicoltura Regnani Lendra reserves the right to modify these General Conditions at any time, by publishing a notice on the Site. Each purchase is governed by the General Conditions in effect at the date the Order is placed.
11. APPLICABLE LAW AND JURISDICTION
11.1. Applicable law
The sales contract between the Customer and Apicoltura Regnani Lendra is deemed to be concluded in Italy and governed by Italian law, particularly by the Consumer Code (Italian Legislative Decree no. 206/2005, as amended) and by Italian Legislative Decree no. 70/2003 on e-commerce.
11.2. Jurisdiction
For any dispute between the parties regarding this contract, the Court of Massa-Carrara (Italy) shall have exclusive jurisdiction.
12. PERSONAL DATA PROTECTION
12.1. Data processing
Any personal data collected when placing an Order or registering on the Site will be processed by Apicoltura Regnani Lendra, acting as Data Controller, in accordance with the legislation in force on personal data protection (Regulation (EU) 2016/679 “GDPR” and Italian Legislative Decree no. 196/2003, as amended by Italian Legislative Decree no. 101/2018).
12.2. Purpose
Data are processed for Order fulfillment, invoicing, after-sales service, and compliance with related legal obligations. Further details are available in the Privacy Policy published on the Site.
13. ALTERNATIVE DISPUTE RESOLUTION (ADR/ODR)
Pursuant to and in accordance with Article 14 of Regulation (EU) no. 524/2013, Consumers residing in EU Member States are informed that disputes relating to these General Conditions may be resolved through the Online Dispute Resolution (ODR) procedure provided by the European Commission, available at the following link:

14. ACCEPTANCE OF THE GENERAL CONDITIONS
By placing an Order through the channels provided on the Site, the Customer declares that they have read, understood, and unreservedly accepted all provisions contained in these General Terms and Conditions of Sale. Pursuant to and for the purposes of Articles 1341 and 1342 of the Italian Civil Code, the Customer specifically approves the clauses concerning limitation of liability, right of withdrawal, shipping conditions, and exclusive jurisdiction.
